Dual Citizenship

Azerbaijan does not permit dual citizenship. This prohibition is enshrined in the Constitution (Article 52) and the 1998 Law on Citizenship.

Key provisions:

  • An Azerbaijani citizen who voluntarily acquires a foreign nationality loses Azerbaijani citizenship automatically upon notification or discovery.
  • Foreign nationals applying for Azerbaijani citizenship must renounce their existing nationality before naturalization is granted.
  • Azerbaijan does not recognize a second citizenship even if acquired involuntarily (e.g., by birth in a jus soli country), though enforcement against persons who have never disclosed the second nationality is limited.
  • Azerbaijani nationals living abroad who acquire foreign citizenship are expected to notify the State Migration Service; failure to do so can result in administrative penalties.
  • Despite the legal prohibition, a significant number of Azerbaijanis informally hold dual nationality, particularly with Russia and Turkey. Enforcement is selective.

Acquisition of Nationality

By Birth (Jus Soli)

A child born on Azerbaijani territory acquires citizenship if:

  1. At least one parent is an Azerbaijani citizen at the time of birth, OR
  2. Both parents are stateless persons permanently residing in Azerbaijan, OR
  3. The parents are unknown (foundling provision).

A child born in Azerbaijan to two foreign parents does not acquire Azerbaijani citizenship solely by birth on the territory.

By Descent (Jus Sanguinis)

Azerbaijani citizenship transmits automatically by descent:

  • A child born to at least one parent who is an Azerbaijani citizen acquires citizenship regardless of place of birth.
  • If one parent is Azerbaijani and the other is a foreign national, and the child is born outside Azerbaijan, citizenship is acquired by mutual consent of the parents. If they disagree, the child may acquire Azerbaijani citizenship by court decision.
  • There is no explicit generational limit, but children born abroad must be registered with an Azerbaijani consulate.

By Adoption

A foreign child adopted by Azerbaijani citizens acquires Azerbaijani citizenship. If only one adoptive parent is Azerbaijani, the child acquires citizenship with the written consent of both adoptive parents. The child must be under 18 at the time of the adoption order.

By Marriage

Marriage to an Azerbaijani citizen does not automatically confer citizenship. However, a foreign spouse benefits from:

  • A reduced residency requirement of 3 years (instead of the standard 5) if married to an Azerbaijani citizen
  • The marriage must have existed for at least 3 years at the time of application
  • All other naturalization conditions apply

Naturalization is granted by presidential decree upon recommendation of the State Migration Service.

Loss and Renunciation

Voluntary renunciation: An Azerbaijani citizen may apply to renounce citizenship. The application is submitted to the State Migration Service and decided by presidential decree. Renunciation is refused if:

  • The applicant has unfulfilled obligations to the state (tax debts, military service)
  • The applicant is a defendant in criminal proceedings
  • Renunciation would render the person stateless

Restoration of Nationality

Former Azerbaijani citizens who lost citizenship may apply for restoration. The procedure requires:

  • Application to the State Migration Service
  • Evidence of prior Azerbaijani citizenship
  • Renunciation of any foreign citizenship acquired in the interim
  • Meeting general conditions (no criminal proceedings, lawful income)
  • Presidential decree approval

The residency requirement may be waived or reduced for restoration applicants at the discretion of the authorities.

Stateless Persons and Foundlings

Azerbaijan is a party to the 1954 Convention Relating to the Status of Stateless Persons and has acceded to the 1961 Convention on the Reduction of Statelessness.

  • A child found on Azerbaijani territory whose parents are unknown is presumed to be an Azerbaijani citizen.
  • Children born in Azerbaijan to stateless parents permanently residing in the country acquire Azerbaijani citizenship at birth.
  • Stateless persons lawfully residing in Azerbaijan for 5 years may apply for naturalization on the same terms as foreign nationals.
