Dual Citizenship

Kyrgyzstan prohibits dual citizenship. Article 50 of the 2010 Constitution states that a citizen of the Kyrgyz Republic shall not hold citizenship of another state simultaneously.

Key provisions:

  • A Kyrgyz citizen who voluntarily acquires a foreign nationality is considered to have lost Kyrgyz citizenship.
  • Foreign nationals applying for Kyrgyz citizenship must renounce all prior citizenships with documented proof.
  • Enforcement has become stricter since 2020 constitutional amendments, though compliance among diaspora communities (particularly those in Russia, Turkey, and Kazakhstan) remains inconsistent.
  • Kyrgyzstan has bilateral agreements with certain CIS countries addressing the prevention of dual citizenship.
  • Despite the prohibition, a significant number of Kyrgyz nationals working in Russia hold Russian citizenship informally. Periodic government campaigns have attempted to address this.

Exception note: The 2007 law contains a provision allowing the President to grant citizenship in exceptional cases, potentially without requiring renunciation. This power has been used sparingly and is not a reliable pathway.


Acquisition of Nationality

By Birth (Jus Soli)

Kyrgyzstan applies a limited jus soli provision:

  • A child born in Kyrgyzstan to stateless parents permanently residing in the country acquires Kyrgyz citizenship at birth.
  • A child born in Kyrgyzstan to parents whose state does not confer citizenship on the child acquires Kyrgyz citizenship.
  • A child born in Kyrgyzstan to foreign parents with established citizenships does not automatically acquire Kyrgyz citizenship.

By Descent (Jus Sanguinis)

Kyrgyz citizenship transmits automatically by descent:

  • A child born to at least one parent who is a Kyrgyz citizen acquires citizenship automatically, regardless of place of birth.
  • If one parent is Kyrgyz and the other is a foreign national, and the child is born outside Kyrgyzstan, both parents must agree. If they disagree, the child acquires Kyrgyz citizenship if the parents reside in Kyrgyzstan at the time of birth.
  • Registration with a Kyrgyz consulate is required for births abroad.

By Adoption

A foreign child under 18 adopted by Kyrgyz citizens acquires Kyrgyz citizenship from the date the adoption is finalized. The child must renounce any prior nationality (or the adoptive parents must arrange this). If only one adoptive parent is Kyrgyz, both parents must consent to the child acquiring Kyrgyz citizenship.

By Marriage

Marriage to a Kyrgyz citizen does not automatically confer citizenship. A foreign spouse may apply for naturalization with a reduced residency requirement:

  • 3 years of lawful residence (instead of the standard 5) if married to a Kyrgyz citizen
  • All other naturalization conditions apply (language, civics, income)
  • Must renounce prior nationality

Ethnic Kyrgyz repatriation (Kairylman):

Kyrgyzstan offers a simplified pathway for ethnic Kyrgyz living abroad:

  • Ethnic Kyrgyz from Uzbekistan, Tajikistan, China, Afghanistan, Pakistan, Turkey, and other countries may apply for citizenship with reduced requirements.
  • No residency requirement for ethnic Kyrgyz applicants.
  • Must demonstrate Kyrgyz ethnic origin through documentation (birth records, family records, community attestation).
  • Must still renounce prior nationality.
  • The program has been particularly significant for Kyrgyz communities in Uzbekistan and China.

Loss and Renunciation

Voluntary renunciation: A Kyrgyz citizen may apply to renounce citizenship through the State Registration Service. Renunciation is denied if:

  1. The applicant has unfulfilled obligations to the state (military service, taxes).
  2. The applicant is a defendant in criminal proceedings.
  3. Renunciation would render the person stateless.

Restoration of Nationality

Former Kyrgyz citizens who lost or renounced citizenship may apply for restoration:

  • Application through the State Registration Service or Kyrgyz consular offices
  • Must demonstrate prior Kyrgyz citizenship
  • Must renounce any foreign citizenship acquired in the interim
  • No mandatory residency period for restoration
  • Processing typically takes 6—12 months
  • Former citizens who lost nationality by acquiring Russian or other CIS citizenship are the most common restoration applicants

Stateless Persons and Foundlings

Kyrgyzstan is a party to the 1954 Convention Relating to the Status of Stateless Persons and the 1961 Convention on the Reduction of Statelessness.

  • A child found in Kyrgyzstan whose parents are unknown is presumed to be a Kyrgyz citizen (foundling provision).
  • Children born in Kyrgyzstan to stateless parents permanently residing in the country acquire Kyrgyz citizenship at birth.
  • Kyrgyzstan has made notable progress in addressing statelessness among post-Soviet populations. Between 2014 and 2019, over 13,000 stateless persons were granted Kyrgyz citizenship through dedicated campaigns.
  • UNHCR has recognized Kyrgyzstan as a regional leader in statelessness reduction within Central Asia.
