Dual Citizenship
Ukraine does not permit dual citizenship. This is one of the most strictly enforced single-citizenship regimes in Europe, though the practical reality is more nuanced.
Legal framework:
- Article 4 of the Constitution of Ukraine establishes a single citizenship principle.
- The 2001 Law on Citizenship (Article 2) states that if a Ukrainian citizen acquires citizenship of another state, that person is recognized exclusively as a citizen of Ukraine by Ukrainian authorities.
- Ukraine does not formally strip citizenship for acquiring a foreign nationality in most cases, but the government does not recognize the foreign citizenship and may initiate proceedings for loss of Ukrainian citizenship.
Practical reality:
- Hundreds of thousands of Ukrainians hold foreign passports (particularly Hungarian, Romanian, Russian, and Polish passports) without Ukraine actively revoking their citizenship.
- Ukraine has periodically discussed legislation to formally legalize dual citizenship (draft bills circulated in 2021-2023), but no law has been enacted as of 2026.
- The war with Russia (since February 2022) has complicated this issue: Ukrainian men aged 18-60 face travel restrictions and military service obligations, and holding a foreign passport does not exempt a Ukrainian citizen from these obligations.
Critical note for naturalization applicants: Foreign nationals seeking Ukrainian citizenship are generally required to renounce their existing citizenship before or upon naturalization, though exceptions exist for refugees and in cases where renunciation is impossible.
Acquisition of Nationality
By Birth
Ukraine applies jus sanguinis primarily, with limited jus soli:
- A child born in Ukraine acquires citizenship if at least one parent is a Ukrainian citizen.
- A child born in Ukraine to foreign parents acquires Ukrainian citizenship only if the parents are stateless, or if the parents’ state does not grant the child citizenship and the child would otherwise be stateless.
By Descent
A child acquires Ukrainian citizenship at birth if:
- Both parents are Ukrainian citizens, regardless of where the child is born.
- One parent is a Ukrainian citizen, regardless of where the child is born — the child acquires Ukrainian citizenship automatically (since the 2001 law; no consent from the other parent is required if the child would not acquire another citizenship, or the parents agree).
- For children born abroad, registration at a Ukrainian consulate is recommended to document citizenship but is not a prerequisite for the child being Ukrainian.
By Adoption
A child adopted by Ukrainian citizens acquires Ukrainian citizenship from the date the adoption is legally finalized. If only one adoptive parent is Ukrainian, the child acquires citizenship if both parents agree or the child resides in Ukraine. Foreign adoption of a Ukrainian child does not automatically terminate Ukrainian citizenship.
By Marriage
Marriage to a Ukrainian citizen does not confer automatic citizenship and does not create a facilitated pathway. The foreign spouse must apply through the standard naturalization process with the same 5-year residency requirement. There is no reduced residency period for spouses.

Exceptions to the 5-year requirement: Persons who are married to Ukrainian citizens, refugees, stateless persons permanently residing in Ukraine, or persons who have rendered outstanding service to Ukraine may have the residency period reduced or waived by presidential decree. However, in practice, the spousal pathway does not formally reduce the 5-year requirement under the current law.
Wartime considerations (since 2022): The full-scale Russian invasion has affected citizenship processing. Military service by foreign volunteers in the Armed Forces of Ukraine may create a pathway to citizenship by presidential decree for exceptional service.
Loss and Renunciation
Voluntary renunciation: A Ukrainian citizen may renounce citizenship by submitting a request. Requirements:
- Must be at least 18 years old
- Must have acquired or been guaranteed citizenship of another state
- Must not have outstanding obligations to the state (taxes, military service, criminal proceedings)
Involuntary loss:

Practical note: Despite the law providing for loss of citizenship upon acquiring a foreign nationality, Ukraine has historically been slow to enforce this provision. Many dual nationals have continued to hold Ukrainian citizenship unchallenged for years.
Restoration of Nationality
Former Ukrainian citizens who lost or renounced citizenship may apply for restoration:
- Must be lawfully residing in Ukraine or applying from abroad through a consulate.
- The standard 5-year residency requirement is waived for former citizens.
- Must meet the language and Constitution knowledge requirements.
- Must not have lost citizenship due to fraud.
- Must renounce any subsequently acquired foreign citizenship.
Persons who were citizens of the Ukrainian SSR and were living in Ukraine at the time of independence (24 August 1991) automatically acquired Ukrainian citizenship. Those who were abroad at independence and did not register may have restoration claims.
Stateless Persons and Foundlings
Ukraine is a party to the 1954 Convention relating to the Status of Stateless Persons and the 1961 Convention on the Reduction of Statelessness.
- A child born on Ukrainian territory who would otherwise be stateless acquires Ukrainian citizenship at birth.
- A foundling discovered in Ukraine is presumed to be a Ukrainian citizen.
- Stateless persons permanently residing in Ukraine may apply for citizenship with a reduced residency requirement (3 years instead of 5).
- Ukraine has a formal statelessness determination procedure, introduced in 2021, allowing stateless persons to regularize their status and access a pathway to citizenship.
